Terms & Conditions

By accepting our services, you are agreeing to the TERMS AND CONDITIONS set forth by DATANav Logistics.

 

Unless and to the extent otherwise specified in writing between “CUSTOMER” and DATAPride, LLC or any of its subsidiaries (DATANav Logistics), (“CUSTOMER”), as consideration for the use of DATANav Logistics agrees to the TERMS AND CONDITIONS set forth below. The TERMS AND CONDITIONS are expressly incorporated into all subsequent shipments, and may be referenced at the site location of these TERMS AND CONDITIONS.

 

The CUSTOMER agrees to these TERMS AND CONDITIONS, which no agent or employee of the parties may change, alter or in any way transform. These TERMS AND CONDITIONS shall apply to all shipments by CUSTOMER. DATAPride, LLC reserves the right to alter or amend these TERMS AND CONDITIONS. If not stated within the carrier's General Rules Tariff, the following TERMS AND CONDITIONS shall control. In the case of conflict between the TERMS AND CONDITIONS contained herein and those set forth by the individual selected carrier's General Rules Tariff, the selected carrier's General Rules Tariff shall control; however, under no circumstance shall the scope of DATAPride, LLC’s liability be greater than specified in these TERMS AND CONDITIONS. All terms, including, but not limited to, all the limitations of liability, shall apply to the selected carrier and their agents and contracted carriers.

 

**The services we offer will be in the notice of each bid.

 

**Transit Time, Pickup Date, Delivery Date is an estimate, unless the freight is booked as guaranteed (pick up day, weekend, holiday are not counted for transit time)

 

**Our bids are based on the information you provide. If there is any change in the dimension, weight, freight class or commodity, it can increase our rate and we will apply said increase to the final charge. For Less Than Truckload (LTL) Freight, DATANav Logistics may use a certified scale and provide a weight certificate.

 

**LTL freight will consist of curbside pickup and/or delivery, unless the customer and DATANav Logistics has agreed upon providing inside delivery or pick up.

 

**Customer must check the item prior to pick up and inform the driver of any damage.

 

**ALL freight MUST be properly packed for road transport. No overhanging no loose pieces will be accepted.

 

**The driver at pickup has the right to refuse any freight.

 

**In the event of weight increase charges or volume increase charges, DATANav Logistics will provide the needed documents to prove these extra charges. Applicable extra charges owed by the shipper can be paid without any extra fee via Cash, Credit Card or Money Order.

 

**If the customer should cancel a confirmed shipment/delivery/pickup, then, DATANav will assess a cancellation fee of 25.00 USD as a result of our time on task.

 

Definition of Business address:

 

Business addresses are those defined as commercial sites. Typically, these addresses are zoned as commercial real estate. Most commercial sites have tractor-trailer access and a loading dock.

 

Definition of Residential address:

 

The fact that a business is being operated from a location does not qualify it as a commercial address. Any business being operated from a home, apartment, or other dwelling where people live on the premises is considered to be a residential address. In most cases, DATANav Logistics will contact you to make an appointment before delivery is attempted to a residential address.

 

**When provided, a Bill of Lading (BOL) should be proofread for any typing error(s). DATANav Logistics will assess an Address Change Fee of $10 if at the scheduled time of pickup, the address needs to be changed

 

**Our normal pickup hour for LTL Freight is Monday - Friday 9:00 AM – 4:00 PM. Any pickup for a time thereafter will be assessed an after hours fee. 

 

**Missing BOL at the pickup location, will result in dry run fee ($25). Shipper MUST provide 1 BOL for the driver and 1 for themselves. Each pallet, box or crate MUST have 1 BOL attached. NO DOCUMENTS, NO PICKUP. NO EXCEPTIONS. A Bill Of Lading may be provided by DATANav Logistics.

 

**No SHIPPER, CUSTOMER OR PERSON OTHER THAN DATANav Logistics has the right to change or modify the following documents: BOL, Shipping Instruction, Invoice, Credit Card Form, Authorization Letter. If the SHIPPER or CUSTOMER edit documents, this change is not valid and legal. Only original documentation and content sent are valid, even if modified.

 

**All of our business is pre paid business. This means that payment must be made before pickup or at least prior to delivery, via Cash, Money Order or valid Credit Card.

 

**Shipments which are not paid will be placed on hold until the freight charges are paid. Storage fees may apply and will be accounted to the customer.
